The purpose of the websites is to provide BRT's clients and the general public with information on the services offered by BRT, the entities holding certifications issued by BRT, news of interest and other content relating to its activity.
Accessing and using the websites confers the status of user and implies acceptance of this Legal Notice. The purchase of services through the websites is also governed by our Terms and Conditions, and certification services are governed by their own contractual documentation.
In the event of any conflict between this Legal Notice and the Terms and Conditions, the service contract or any other specific conditions applicable to a particular service, the latter shall prevail with regard to that service.
BRT may at any time modify the information contained on the websites, their configuration and their presentation, and may temporarily suspend access to them for technical, maintenance or security reasons. The current version of this Legal Notice will be the one published on the websites at any given time.
Users undertake to use the websites and their content in accordance with the law, this Legal Notice, good faith and public order. In particular, users undertake not to use them for unlawful purposes or in a way that harms the rights of BRT or third parties, not to introduce viruses or any other harmful code, and not to attempt to gain unauthorised access to restricted areas, systems or databases of BRT.
Access to certain areas or services of the websites, such as the entity profile on the Biosphere Sustainable platform, may require prior registration. In that case, the user undertakes to provide truthful, accurate and complete data, and to keep it updated.
Access credentials (username and password) are personal and confidential. The user must safeguard them diligently and must not share them with unauthorised third parties. The entity holding the profile shall be responsible for actions carried out using its credentials, unless it has notified BRT of their loss or misuse. If unauthorised access to their account is detected, this must be reported immediately to info@biospheresustainable.com.
BRT may suspend or cancel a registration where the data provided is false or the account is used in a manner contrary to this Legal Notice, having first notified the user unless the seriousness of the case prevents this. The user may request the cancellation of their registration at any time.
BRT owns, or holds the corresponding licence for, the intellectual and industrial property rights in the websites and their content (texts, images, design, source code, logos, trade marks and other elements).
The Biosphere mark, its logos, seals and labels, as well as the Biosphere Scheme and its visual identity, are the property of the Responsible Tourism Institute (RTI). Their use by certified entities is governed by the Regulations for the use of the Biosphere mark and labels. As an authorised certification body, BRT uses the Biosphere mark in accordance with the conditions established by the RTI to identify the certifications granted under the Biosphere Scheme.
The reproduction, distribution, public communication or transformation, in whole or in part, of the content of the websites without the prior written authorisation of the rights holder is prohibited, except to the extent necessary for consulting or printing it for personal, non-commercial purposes.
Any third-party trade marks, trade names or logos appearing on the websites belong to their respective owners and are recognised as such. They appear for information purposes and do not necessarily imply endorsement of the corresponding products or services. Such owners may request the modification or removal of any information concerning them by writing to info@biospheresustainable.com.
The websites may include links to third-party pages. BRT does not control and is not responsible for their content, unless it has actual knowledge of its unlawfulness and fails to act diligently to remove or disable the link, in accordance with Article 17 of the LSSI. The conditions for linking to our websites are set out in Section 8 of our Terms and Conditions.
If you consider that any content published on the websites, including the entity profiles in the public repository, is unlawful or infringes the rights of third parties (for example, intellectual or industrial property rights), you may report this to info@biospheresustainable.com indicating:
BRT will acknowledge receipt of the notification, will review it diligently and, where appropriate, will remove or block the content. It will inform the notifying party of its decision and, where applicable, the entity that published the content.
BRT endeavours to ensure that the information on the websites is correct and up to date, but does not guarantee that it is free from errors or that the websites will be available without interruption. To the extent permitted by law, BRT shall not be liable for any damage that may arise from the use of information published for general purposes, from service interruptions beyond its control, or from the presence of viruses or other harmful elements that could not be detected despite reasonable security measures having been taken.
BRT applies appropriate technical and organisational measures to protect the security of the websites and of the information processed on them. However, the user acknowledges that no system connected to the Internet is completely invulnerable, and we therefore also recommend adopting security measures on your own devices.
This limitation does not affect any liability that cannot be excluded by law, nor the rights granted to users under consumer protection legislation.
BRT processes users' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights. Information obtained or created during certification processes is handled in accordance with our Confidentiality Policy.
Any comments, suggestions or ideas that you voluntarily send us through the general contact channels of the websites may be used by BRT to improve its services, without giving rise to any consideration. This does not apply under any circumstances to the information or documentation that entities provide as part of their certification processes.
This Legal Notice is governed by Spanish law. For any dispute relating to the websites, the provisions of Sections 18 and 19 of our Terms and Conditions shall apply. If you are a consumer, you may in any event bring proceedings before the courts of your place of residence.
